Abstract: This memorandum examines the juridical status of India and Pakistan following partition under the Indian Independence Act, 1947. It addresses the continuity of international personality, treaty obligations, and membership in international organizations such as the United Nations. The document presents the dominant view that the Dominion of India continues the international personality of pre-partition India, while Pakistan emerges as a new state. A dissenting opinion by Mr. Mohd. Ali argues for equal succession of both dominions. Prepared for the Partition Council, this legal analysis informed the diplomatic and constitutional framework during the transition led by figures such as M.A. Jinnah.

Description: This collection consists of a legal memorandum and related notes prepared for the Partition Council in August 1947, discussing the inheritance of international rights and obligations by India and Pakistan post-partition. The document outlines principles of international law, referencing historical precedents and correspondence with the British government. It includes marginal notes, dates, and references to key figures such as Mr. Patel and Mr. Mohd. Ali, reflecting the high-stakes legal and diplomatic deliberations during the partition. Relevant to researchers studying international law, South Asian history, and the foundational legal debates in the early administrations of India and Pakistan under leaders like M.A. Jinnah.
