Abstract: This is the written statement of defence filed by the Government Pleader, Cuttack, on behalf of the Defendant, the Province of Orissa, in Original Suit No. 122 of 1939. The plaintiff, Sheikh Abdul Latif, a police constable, was dismissed from service for overstaying his leave and failing to return to his duty in Sambalpur district. The defendant's statement denies the maintainability of the suit in a civil court and contests the plaintiff's claims of family illness and his own subsequent illness as justifications for his absence.
